Nike Thailand victory brings good news for importers

The Supreme Court of Thailand has ruled in favour of Nike in a dispute over royalties with the Customs Department. The case sets a welcome precedent for companies looking to import goods from a third party.

Nike Thailand had entered into a licence agreement with Nike International and was the sole distributor of Nike products in Thailand.

After Nike Thailand imported golf balls from Bridgestone Sport USA in May 2002, the customs department objected to the taxpayers custom tariff declaration, with import duty at the rate of 10%, and imposed an additional 2% import duty for the royalty payment to Nike International...
