ECJ backs Rank in £250 million VAT reclaim

The ECJ has ruled in favour of Rank Group's claim that it overpaid VAT to HM Revenue & Customs by more than £250 million ($397 million).

The ECJ rejected an appeal by HMRC over the £253.4m awarded to Rank, a gaming business, by UK courts for overpaid VAT on gaming services including bingo dating back to 1973

The court ruled that taxing similar games differently infringes fiscal neutrality.

Despite various victories in UK courts, following an appeal from HMRC, the ECJ have supported Rank’s position."This is a fair decision which corrects the unlawful application of VAT...
